Welcome to Tamil Learn. These Terms & Conditions (“Terms”) govern your access to and use of the Service, operated by Arx Foundry (“we,” “us,” “our”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please don’t use the Service.
1. Eligibility & supervision of minors
The Service is intended for adults aged 18 or older, and for minors only when used under the direct supervision and with the consent of a parent or legal guardian. The Service is not directed to children under 13 (or the minimum age in your jurisdiction). If you allow a minor to use the Service, you do so as the responsible adult, you accept these Terms on their behalf, and you are responsible for their use and for any information processed in connection with it.
2. License & acceptable use
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial learning. You agree not to misuse the Service, including by copying, scraping, reverse engineering, reselling, disrupting, or attempting to gain unauthorized access to it or its content.
3. Intellectual property
The Service and its content — including lessons, audio, text, designs, and software — are owned by us or our licensors and are protected by intellectual-property laws. No rights are granted except as expressly stated here.
4. Data, cookies & communications
You acknowledge and agree that we collect, use, share, and otherwise process information as described in our Privacy Policy, including for analytics, research, product development, and disclosure to partners and third parties (including, in some cases, for valuable consideration and in aggregated or de-identified form).
The Service uses cookies, local storage, and similar technologies — for essential functionality (such as saving your progress) and for analytics and the purposes described in the Privacy Policy. These technologies are required for the Service to function, and by using the Service you consent to their use; disabling them may prevent the Service from working properly.
You also consent to receive communications from us electronically (such as in-app messages or emails), and you agree that electronic communications satisfy any legal requirement that communications be in writing.
5. Feedback
If you send us ideas, suggestions, or other feedback, you grant us a perpetual, worldwide, royalty-free license to use it for any purpose without restriction or obligation to you.
6. Third-party services & links
The Service may rely on or link to third-party products and services. We are not responsible for third-party content, products, or practices, and your use of them is governed by their own terms and policies.
7. Educational disclaimer; “as is”
The Service is provided for general educational purposes on an “as is” and “as available” basis, without warranties of any kind, express or implied, including any warranty of accuracy, fitness for a particular purpose, language fluency or proficiency outcomes, or non-infringement. We do not guarantee that content is error-free or that the Service will be uninterrupted.
8. Limitation of liability
To the maximum extent permitted by law, we and our affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the prior twelve months or USD $50.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising out of your use of the Service or your breach of these Terms.
10. Resolving disputes (arbitration & class-action waiver)
Most concerns can be resolved quickly — please contact us first and we’ll try to help. To keep any remaining disputes efficient, you and we agree that, except as noted below, disputes relating to the Service or these Terms will be resolved by binding individual arbitration rather than in court, and that claims may be brought only in an individual capacity and not as part of any class or representative action. You and we also waive the right to a jury trial.
Exceptions: either party may bring a claim in small-claims court, and either party may seek injunctive relief to protect intellectual-property rights. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing us; opting out will not affect the remainder of these Terms. If any part of this section is held unenforceable, the remainder still applies, and the class-action waiver is severable.
11. Changes; suspension; termination
We may modify, suspend, or discontinue the Service or these Terms at any time. Material changes are indicated by updating the “Last updated” date, and continued use after changes constitutes acceptance. We may suspend or terminate access at our discretion.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which Arx Foundry is established, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there for matters not subject to arbitration, except where mandatory consumer-protection law provides otherwise.
13. Miscellaneous
These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them freely. We are not liable for delays or failures caused by events beyond our reasonable control. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
